Who we are

MorningCount is a business name of Juniper Creative LLC, the Rochester, New York company that also operates as Moxie Digital. “We,” “us,” and “our” in these terms mean MorningCount.

What these terms cover

By using this website or the live demo, you agree to these terms. If you don’t agree, please don’t use them.

These terms do not cover the MorningCount platform as used by a school or district, including each district’s own MorningCount site. That use is governed by the written agreement between the district and us, or between the district and the partner it purchased through, including the district’s data privacy agreement. If anything on this page conflicts with that agreement, the agreement wins.

The website

The website is here to explain MorningCount. We work to keep it accurate, but features, screenshots, and descriptions change as the product does, and some content may be out of date at any given moment. Figures on the Pricing page are for planning; the price a district pays is set in its written quote and agreement.

The live demo

The demo is a shared sandbox: a made-up district with made-up schools and generated student names, open to anyone, reset every night. A few rules keep it useful for everyone.

• Don’t enter real information about real people. No real student names, no real staff names, no contact details, nothing personal. Treat anything you type as public. Other visitors can see it until the next reset.
• Don’t rely on it. The demo is for trying MorningCount, not for running a real lunch count. It resets nightly, carries no uptime commitment, and is not the production platform districts use.
• We can remove anything, block access, change the demo, or take it down at any time, without notice.

Acceptable use

Please don’t:

• try to gain access you’re not meant to have, or probe, scan, or test the security of the website or the demo without our written permission (security reviews are welcome; ask first);
• overload, scrape, or automate requests against either;
• enter anything unlawful, abusive, or that infringes someone else’s rights;
• pretend to be someone you’re not.

We may block anyone who does.

Ownership

The website, the software, and the MorningCount name and logo are ours. You’re welcome to link to any page and to share screenshots with colleagues who are evaluating MorningCount. Beyond that, please don’t copy, reproduce, or build on the site, the software, or the brand without our written permission.

The contact form

What you send through the contact form is used to reply to you and to follow up about MorningCount. Our Privacy Policy explains how we handle it.

Not for children

The website and the demo are for adults evaluating MorningCount for a school. They are not directed at children, and we don’t knowingly collect personal information from children through them. Students use MorningCount only in the classroom, through their school, with no accounts and no logins.

Links to other sites

Some pages link to other sites, including addmoxie.com. We’re not responsible for their content or their privacy practices.

No warranty

The website and the demo are provided as they are, without warranties of any kind, express or implied, including any warranty that they will be accurate, uninterrupted, or error-free.

Limits on liability

To the fullest extent the law allows, we are not liable for indirect, incidental, or consequential damages, or for any loss of data or profits, arising from your use of the website or the demo. Nothing in these terms limits the obligations we take on in a district’s written agreement.

Governing law

These terms are governed by the laws of the State of New York. Any dispute about them will be heard in the state or federal courts located in Monroe County, New York.

Changes

We may update these terms. The date at the top shows when they last changed. Using the website or the demo after a change means you accept the new terms.
